Layby

Golden Girl Au offers credit card and Afterpay payment options through the website. Layby may also be offered on selected pieces valued over $2,500, strictly on a case-by-case basis and at my discretion.

Entering into a Layby

A 30% initial payment is required when a layby is agreed.

Before the layby commences, I will provide you with a written Layby Agreement identifying the piece, its total purchase price, the initial payment, the agreed payment schedule, the maximum term of the layby and the terms applying to cancellation and termination.

The agreement must be signed and returned to me.

Depending on the value of the piece, the remaining balance will generally be paid in weekly instalments over six to eight weeks. The exact payment dates and amounts will be specified in your individual Layby Agreement.

By entering into a layby, you are asking Golden Girl Au to remove a unique vintage piece from sale and hold it exclusively for you for the agreed period. During that time, the piece cannot be purchased by another customer.

The jewellery remains the property of Golden Girl Au and will not be dispatched until the purchase price has been paid in full.

Change of Mind

Please choose your layby piece carefully and enter into the agreement only if you intend and are financially able to complete the purchase.

Changing your mind, finding another piece elsewhere that you prefer, finding a similar piece at a different price, or subsequently seeing another piece on the Golden Girl Au website or Instagram that you would prefer does not entitle you to transfer the money paid under your existing layby to another piece.

A layby cannot be swapped, transferred or moved from one piece to another simply because your preference changes during the layby period.

This does not remove your statutory right under the Australian Consumer Law to terminate a layby agreement before the goods are delivered. If you choose to exercise that right, the cancellation will be dealt with in accordance with the termination provisions below.

Customer Termination

Under the Australian Consumer Law, you may terminate a layby agreement at any time before the piece is delivered to you.

If you terminate the agreement, Golden Girl Au may charge a termination fee where that fee has been clearly specified in your Layby Agreement. Any termination fee charged will be limited to Golden Girl Au's reasonable costs relating to that layby, as permitted by the Australian Consumer Law.

The applicable termination provisions and the basis upon which any termination charge is calculated will be clearly set out in your individual Layby Agreement before you sign it.

Any amount you have paid above a lawful termination charge will be refunded to you in accordance with the Australian Consumer Law.

A request to terminate a layby must be made in writing.

Missed Payments

Payments must be made in accordance with the payment schedule contained in your Layby Agreement.

If a scheduled payment remains unpaid for seven days and an alternative arrangement has not been agreed with me in writing, this will constitute a breach of the Layby Agreement and Golden Girl Au may terminate the agreement and return the piece to sale.

If you are experiencing difficulty meeting a scheduled payment, please contact me before it becomes overdue. Where appropriate, I may agree to an alternative arrangement. Any variation to the original payment schedule must be agreed in writing.

Golden Girl Au will only terminate a layby in circumstances permitted under the Australian Consumer Law.

Australian Consumer Law

Nothing in these terms is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Your rights relating to faulty goods, goods with a major problem, or goods that materially differ from their description are not affected by these layby terms.

Once the final payment has been received, your piece will be dispatched using Golden Girl Au's usual complimentary, fully insured Australia Post Express Post service with signature on delivery.
